This Privacy Policy explains how e-contract collects, uses, stores and discloses your personal information when you use our platform. We handle your personal information in accordance with the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
1. Who we are
This policy explains how e-contract (e-contract.com.au) ("we", "us", "our") handles your personal information. We are committed to protecting your privacy and complying with the Australian Privacy Principles under the Privacy Act 1988 (Cth).
2. What we collect
Depending on how you use the platform, we may collect:
- Identity & contact details - name, email, phone number, business name.
- Account details - username, password (stored hashed), profile information, photo.
- Business/verification details - ABN and the results of automated ABN checks; licences or qualifications you choose to provide.
- Activity data - jobs posted/applied for, messages, contacts, agreements, reviews, and how you use the platform.
- Technical data - IP address, device/browser type, and (if used) cookies and analytics data.
We collect personal information directly from you, and automatically as you use the platform.
3. Why we collect and use it
We use personal information to:
- create and manage your account and profile;
- connect members and let you contact each other;
- operate, secure, support and improve the platform;
- run verification checks (e.g. ABN);
- communicate with you about the service;
- send marketing only where you have consented - you can unsubscribe at any time (Spam Act 2003 (Cth));
- comply with our legal obligations.
We only use your information for the purposes it was collected for, related purposes you'd reasonably expect, or as required by law.
4. What other members can see
- Your public profile shows the information you choose to make public.
- Your email address is kept private and is not shown to other members.
- Your phone number is private by default. If you keep it private, it is only disclosed to another member after a job has been accepted by both parties. If you set it to public, it is visible to any logged-in member on your profile so they can contact you directly. You can change this anytime. Numbers are never shown to logged-out visitors.
5. When we share information
We do not sell your personal information. We may share it with:
- other members, as described above and as needed to connect you;
- service providers who help us run the platform (e.g. hosting, email, analytics, payment processing), under confidentiality obligations;
- authorities or third parties where required or permitted by law, or to protect our rights, members or the public.
6. Overseas disclosure
Some of our service providers (for example, cloud hosting) may store or process data outside Australia. Where this happens we take reasonable steps to ensure your information is handled consistently with the Australian Privacy Principles.
7. Cookies and analytics
We may use cookies and similar technologies to keep you logged in, remember preferences, and understand usage. This may include analytics tools such as Google Analytics and Microsoft Clarity. You can control or disable cookies through your browser settings; some features may not work without them.
8. How we store and protect it
We take reasonable steps to protect personal information from misuse, loss and unauthorised access - including hashing passwords and access controls. No system is completely secure; you use the platform at your own risk and are responsible for keeping your login confidential. We keep personal information only as long as needed for the purposes above or as required by law, then delete or de-identify it.
9. Accessing and correcting your information
You can access and update most of your information in your profile. To request access to, or correction of, personal information we hold, contact us (below). We'll respond within a reasonable time; if we decline, we'll tell you why.
10. Data breaches
If a data breach likely to cause serious harm occurs, we will respond in line with the Notifiable Data Breaches scheme, including notifying affected individuals and the Office of the Australian Information Commissioner (OAIC) where required.
